India government approves draft legislation banning instant triple talaq

The Supreme Court paved the way for the proposed bill after it ruled in August that it was unconstitutional to allow men invoke triple talaq - the practice of repeating the word "talaq", or "divorce", three times to annul one's marriage.

Noorjahan Deewan, a social worker who works with Muslim women in the city said since the verdict, they have received three such complaints. There are more than hundred cases registered in Uttar Pradesh and Bihar which falls under this category.

Law Minister Ravi Shankar Prasad confirmed that the "Muslim Women Protection of Rights on Marriage Bill" has been approved but refused to share details as Parliament is in session.

Activist Zakir Soman said the Muslim Personal Law Board and the Muslim community are not taking proper care of triple talaq victims, and such women should be given justice as per law.

They include the Constitution (SC and ST) Orders (Amendment) Bill, 2016, Inter-State River Water Disputes (Amendment) Bill, 2017, Lokpal and Lokayuktas and other related Law (Amendment) Bill, 2014, Whistle Blowers Protection (Amendment) Bill, 2015, Armed Forces Tribunal (Amendment) Bill, 2012, and Public Premises (Eviction of Unauthorised Occupants) Amendment Bill, 2017. So, it should not be the matter of ego for the Muslim Personal Law Board. The bill drafted made the instant triple talaq in any form, oral, written or electronic, a criminal offence. There is a provision for monetary support from the government for the victims.

"Women are not being tortured in the name of triple talaq".

Cabinet minister Ravishankar Prasad that he can not discuss the details of the bills but it is a progressive bill which aims to solve the designated goal.

President of Muslim Women League, Naisha Hasan, said, "Before approving the draft of the bill, the Centre should have held discussions with the people..."

According to the draft law, which would be applicable to the entire country except Jammu and Kashmir, giving instant talaq would attract a jail term of three years and a fine.

The court had also held that triple talaq was not integral to Islam.

He also attached a memorandum dealing with the legal and policy ramifications of criminalising triple talaq. So, the triple talaq bill, we consider as a direct interference in the religious matters of the largest community.
