Last week, six members of the Empire cast wrote a letter to producers of the show, pleading with them to bring Jussie Smollett back for the sixth season.
In February, police arrested Smollett, accusing him of staging the attack as part of an effort to generate public sympathy and improve his "Empire" contract, with which he was reportedly dissatisfied.
In a statement obtained by Fox News at the time, the city's law department said it filed a civil complaint against Smollett, 36, in the Circuit Court of Cook County "that pursues the full measure of damages allowed under the false statements ordinance".
On April 24, Empire stars Terrence Howard, Taraji P. Henson, Bryshere Y. Gray, Trai Byers, Gabourey Sidibe and Nicole Ari Parker released a letter calling for the embattled actor to return to the drama, after creator Lee Daniels admitted the studio was facing a "dilemma" with regards to Smollett's future.
The lawsuit laid out a detailed account of the allegations against Smollett, who told police he was attacked by two men who shouted homophobic slurs at him, wrapped a noose around his neck and poured an unknown liquid on him.
Following the dismissal of the charges, which prompted pointed rebukes from top Chicago officials, Twentieth Century Fox said in a statement that "Smollett has always maintained his innocence and we are gratified that all charges against him have been dismissed".
On Tuesday, Fox announced a season 6 renewal for Empire.
"Empire" is a massive breadwinner for FOX.
Smollett, who is gay, portrayed singer-songwriter Jamal Lyon on the show, a character who is also gay.
